1. Your holiday contract
The property known as “Casa Tranquilla” is offered for holiday rental on behalf of the owners (later referred to as the Owners) to the renter (the Client). All bookings accepted by the Owners are subject to these conditions which are deemed to have been accepted in full by the Client and all persons in the party. When you make a booking you guarantee that you have the authority to accept and do accept on behalf of your party the terms of these booking conditions. You must be at least 21 years old to make a booking with us. Payment of the deposit constitutes acceptance of the booking conditions. Your contract with us will be governed by English Law and is subject to the jurisdiction of the English Courts at all times.
2. Paying for your holiday
Please quote your name when paying. Our preferred method of payment is by bank transfer using your online or telephone banking. We will email you our bank details. It is the cheapest and most secure method. Alternatively we also accept cheques, however Paypal and card payments will incur a 5% levy. Directions and key collection information will be issued three weeks prior to your arrival. A deposit of 25% of the total villa rental cost is payable with the booking form. Confirmation of booking/deposit will be sent by email as soon as the deposit is cleared and will state the balance due date. The balance is to be paid eight weeks prior to departure including the security deposit of £300 that will be refunded subject to a property inspection after vacation of the villa. If the Owners do not receive this payment by the balance due date specified on the deposit receipt/invoice and has no notification from the Client, the booking will automatically be cancelled and the deposit retained. If the booking is made eight weeks or less before rental start date it must be accompanied by full payment. Please do not book travel arrangements until you have received confirmation of booking.
3. Security deposit
A refundable deposit of £300 will be added to your invoice. This is to cover damage that may occur in you villa during your holiday and will be returned as soon as the property has been checked and the owner notified. This deposit also covers any penalties that may be levied against the Client for not complying with these booking conditions.
4. Confirmation
Please check your confirmation immediately on receipt. You must contact us straightaway if any information appears to be incorrect. We reserve the right to refuse your booking. If we do this we will refund any money already paid to us.
5. If you change your booking
If, after our confirmation has been issued, you wish to change your booking in any way, for example your chosen arrival date, we will do our utmost to make these changes but it may not always be possible. Any request for changes to be made must be in writing from the person who made the booking.
6. If you cancel your holiday
To cancel the entire holiday, the Party Leader must write to us using recorded delivery. Cancellation takes effect on the date we receive your letter. If you cancel after we confirm your booking, you must compensate us for losses, as we incur costs from the moment you make the booking. If you have to cancel for a reason covered by your insurance policy, you should be able to recover the cancellation charges. Claims must be made directly to the insurance company concerned. The following cancellation charges apply:
More than 8 weeks prior to departure, loss of deposit.
56 – 29 days prior to departure, 50% of the cost of your holiday.
28 – 0 days prior to departure, 100% of the cost of your holiday.
7. If we change or cancel your holiday
It is unlikely that we will have to make any changes to your holiday arrangements. In the event of minor alterations, we will do our best to notify you before you travel. If a significant change or cancellation has to be made to your holiday arrangement we will notify you as soon as possible. You may then: a) accept the changed arrangements; or b) cancel your booking completely, in which case we will refund you all monies paid by you except for payment charges. Any refund will be restricted to villa rental cost and the Owners are not liable for any cancellation charges for travel arrangements, etc.
8. Delays
We are unable to accept any liability for delays while traveling. In such circumstances you may be able to make a claim under your insurance policy.
9. Weather
We are unable to accept any liability for the results of inclement weather conditions.
10. What is included
The villa rental includes the cost of water, gas, electricity, maintenance of swimming pool and garden. All linen, bath and pool towels are provided and changed weekly.
11. What is not included
The villa rental price does not include any personal insurance, travel, transportation or airport to villa transport.
12. Occupancy and Check-in/Check-out times
The villa will be ready for occupancy from 3:00pm on the rental start date and must be vacated by 10.00am on the rental end date to allow for cleaning and housekeeping to prepare the villa for the next guests. Failure to comply with these terms may result in forfeiture of the security deposit. The villa is reserved exclusively for the people named on the confirmation and no other persons are permitted to stay at the accommodation unless this has been agreed with us in writing.
13. Maximum Number of Persons
Under no circumstances may more than the maximum number of persons specified in the villa description or booking form occupy the villa. The villa cannot be re-let/sublet to any other group/party. The Owners and their representatives reserve the right to refuse admittance to the villa to the Client and their party if they are in breach of any of these conditions.
14. Pets
To ensure the villa is as low-allergen as possible for the Owners and other guests, please note we are unable to allow pets of any kind.
15. Smoking
For the enjoyment of other guests and the owners, there is a strict no smoking policy inside the villa.
16. Rights of Access
The Owners and their representatives or their sub-contractors have the right of access to the property at any time with due regard to the convenience of the Client for the purpose of inspection of the property and to carry out any essential repair or maintenance work.
17. Clients’ Responsibilities
The Client is responsible for taking all reasonable care of the property and its contents. The client shall ensure that no member of the party engages in any activity in or around the swimming pool, which may cause offence or pollution to the water or damage to the structure or filtration equipment – this includes unacceptable anti-social behaviour. Finally, we politely ask the Client to ensure no item at all is removed from the villa during the rental period.
18. Check-out Requirements
At the end of the rental period please ensure all equipment, utensils, furniture, etc., is left clean and tidy. All cutlery and crockery must be cleaned and put away. Used linen and towels should be placed in the Utility room. Please do not strip unused beds. The client should also ensure that the barbeque is cleaned and that all rubbish is bagged and placed in the municipal bins.
19. Holiday insurance
The villa rental cost does not include any personal insurance cover of any kind. The Client confirms that insurance will be purchased for the entire party to cover holiday cancellation, personal accident and medical insurance. We highly recommend that any insurance purchased have a 24-hour emergency telephone service.
20. Our liability to you
We accept responsibility for ensuring that your accommodation is supplied as described on the website. Our liability in all cases shall be limited to a maximum of your payments to the Owners. We will not accept responsibility for any of the following circumstances a) if you or any member of your party is at fault, b) if the fault is of someone else not connected with providing the services which make up the holiday which we have confirmed to you, c) any unusual or unexpected circumstances beyond our control which we could not have avoided even if we had used all possible care, d) any event which we could not help or prevent.
21. Force Majeure
The Owners regret that they cannot accept liability or pay compensation where the performance of our contractual obligations is prevented or affected by ‘force majeure’. In these Terms & Conditions ‘force majeure’ means any event which we or the supplier of the service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, technical problems, with transportation, closure of ports and ferries, quarantine, epidemics, weather conditions, government action or other events outside the Owners control.
22. Injury & Damage
The Owners and their representatives will not accept any liability for personal injury, death, loss or damage to personal effects and motor vehicles to the Client or any member of the party arising from the provision of letting the accommodation.
23. Keys
Detailed instructions for key collection and directions to the villa will be sent to the Client by email three weeks prior to arrival.
24. Local activities, facilities and excursions
Local activities, facilities and excursions are neither run nor controlled by us. The discretion to partake in any such activities, facilities, or excursions is entirely at your own risk. You are responsible for taking sensible precautions for your own safety and for the safety of any children or family members for whom you are responsible.
25. If you have a complaint
If you have cause for complaint whilst on holiday, this must be brought to our attention immediately so that action can be taken at the time to rectify the problem. Should we be unable to resolve the matter, details of the complaint must be notified to us in writing within 7 days of the end of your holiday. Neither the Owners nor their representatives shall have any liability for any complaint submitted after the booking period.
26. Your personal information
We will keep your personal information confidential. We will never disclose any personal information to any third party at any time nor will we rent or sell your personal information to any other person or company. We will only pass on personal details when required by law.
